These Terms of Service ("Terms") govern your access to and use of Nexus360, a clinical 360-degree feedback platform provided by Hypnos Medical ("we", "us", "our"), accessible at nexus360.hypnos.one. By creating an account or using the platform, you agree to these Terms.
Nexus360 allows clinicians to design, distribute, and collect structured peer and patient feedback for professional development purposes, including generating reports intended to support Continuing Professional Development (CPD) portfolios (e.g. for ANZCA, FPM, MCNZ, or equivalent bodies).
Nexus360 does not verify, endorse, or guarantee that any report or output satisfies the specific CPD requirements of any college or regulatory body. It is your responsibility to confirm with your relevant college or regulator that any report generated through Nexus360 meets their requirements.
The platform supports several account roles, including Clinician, Facilitator, and Administrator. You are responsible for:
Where a campaign uses a Facilitator, that person plays an independent role in distributing surveys and releasing results, intended to protect the integrity and anonymity of the feedback process. Facilitators must act in good faith and must not attempt to identify individual respondents or manipulate the distribution or release of results in a way that undermines this purpose.
We design Nexus360 so that individual survey responses cannot be traced back to the person who submitted them, and collated results are only released once a minimum response threshold is met. You must not attempt to identify, or take any action intended to identify, an individual respondent, and you must not use the platform in a way that could reasonably be expected to compromise respondent anonymity (for example, by structuring a campaign so that the response threshold could only be met by one specific person).
You agree not to:
Nexus360 is offered under the following current pricing structure:
We reserve the right to change our pricing with reasonable notice to existing subscribers.
The Nexus360 platform, including its software, design, and templates (excluding content you upload or survey responses collected through it), is owned by Hypnos Medical. You retain ownership of the content you create and the responses collected through your use of the platform, subject to our Privacy Policy governing how that data is stored and processed.
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.
Nexus360 is provided "as is" and "as available". While we take reasonable steps to maintain the platform's availability and accuracy, we do not warrant that the service will be uninterrupted, error-free, or fit for any particular purpose beyond what is described in these Terms. Reports generated by the platform are aids to reflection and professional development and should not be treated as a substitute for formal performance review, clinical governance processes, or regulatory assessment.
To the maximum extent permitted by law, Hypnos Medical will not be liable for any indirect, incidental, or consequential loss arising from your use of the platform, including loss of data, loss of CPD credit, or reputational harm arising from feedback content submitted by third parties.
We may suspend or terminate your access to the platform if you breach these Terms, including any breach of the anonymity or acceptable use provisions above. You may stop using the platform and request account deletion at any time — see our Privacy Policy for how to do this.
We may update these Terms from time to time. We will make reasonable efforts to notify existing users of material changes. Continued use of the platform after a change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
